Arrest of pro-lifers in AL 'unwarranted'

In February 2009, several members of the youth pro-life group were arrested while demonstrating in Birmingham. A lawsuit was subsequently filed. Those charges have since been dropped and the lawsuit settled.
 
Allison Aranda, staff counsel with the Life Legal Defense Foundation, was asked if members of Survivors faced arrest again when they returned one year later with their pro-life signs. "The city abided by the terms of their agreement and did not arrest them," she shares, referring to demonstrations on July 22.
 
"However, when the group went to the University of Alabama at Birmingham [on July 26], they were met by administrators who told them that they were not permitted to enter the public college campus -- and [that] if they stepped onto the campus, which is a public university, they would be arrested."
 
That response followed a dialogue the students had with the administrators in which the school officials were asked "Isn't this a public college campus? Isn't this public property?"
 
Their response? "The college administrators once again said, well, yes and no -- and it was almost as if [they were saying] it's public for our students, but it's not for you," Aranda explains.
 
UAB police subsequently arrested two Survivors members for failing to leave the campus and for videotaping the incident. They were released after day-long negotiations with the campus attorney and no charges have been filed -- yet.
 
Aran is hopeful Life Legal Defense Foundation can communicate with the school to educate the educators on the Constitution -- but says if that does not happen, further action will be taken.
