ACLU targets Gideons in Texas school case

Gideons biblesThe American Civil Liberties Union is investigating what it calls religious liberty violations in a Texas school district.

 

One of the complaints is that the Navasota school district permits the Gideons to distribute Bibles at its schools. Attorney Roger Byron of Liberty Legal Institute notes the Christian organization has been doing so for decades.
 
"There's absolutely nothing unconstitutional with the Gideons distributing Bibles in the schools, if that particular school district allows other organizations, secular or what have you, to distribute literature items in the school district," he points out.
 
Teachers have also been accused of participation in Christian extracurricular clubs. Byron says that is legal under very restricted circumstances. "Participation by any school official or school teacher is supposed to go no farther than custodial," he notes.
 
Texas educationThe ACLU also submitted a complaint about the display of crosses. If a teacher wants to wear a cross as a necklace, for example, it is legal, but the display of crosses otherwise is limited, Byron contends. "Whatever display they may be talking about, could it be seen by a reasonable person as the school endorsing a particular religion?" he asks.
 
Liberty Legal Institute is offering the district free legal assistance, while the ACLU complains the district is intentionally ignoring the First Amendment.
