Liberty Counsel wins again over ACLU

The Liberty Counsel has defeated the ACLU again in Pensacola, Florida. The first case was settled August 24 when Federal District Judge Casey Rodgers ruled that Michelle Winkler was not in contempt of court for having her husband pray at an awards banquet to honor teachers at Pace High School. The off-campus event was privately funded and outside school hours. (See AFA Journal, 10/09.)
In a second case, the ACLU brought the same charge of contempt of court against Pace High School principal Frank Lay and athletic director Robert Freeman.
Pace High School students came to the courthouse wearing T-shirts with the image of a potato chip that read: “Lay’s Supportive Patriots.” The steps of the courthouse and streets surrounding it were filled with other supporters.
Congressmen Randy Forbes (R-VA), Mike McIntyre (D-NC), Jeff Miller (R-FL) and 60 other members of the Congressional Prayer Caucus wrote a letter of support to Lay and Freeman. In it, the congressmen said they were “standing with you in support as you face your trial on Thursday because of the offering of prayer.”
They also spoke of the case on the House floor. Forbes said, “There will come a day when the speaker of this House will be hauled into federal court and threatened with jail because she dares to stand at that podium where you stand tonight and ask the chaplain to start our day with prayer.”
