A pro-family spokesperson in Wisconsin labels a losing lawsuit's argument as "just a sneaky attempt to tear down what the voters clearly wanted."
It was announced on Wednesday that the Wisconsin Supreme Court has upheld that state's constitutional ban on homosexual "marriage" and civil unions. All seven justices voted to uphold the vote of the people that was registered on the matter more than three years ago. The court rejected a lawsuit that claimed the amendment approved by voters violated a rule that limits referendum questions to a single subject. The person who filed the lawsuit had argued that homosexual marriage and civil unions were two different subjects. But the court disagreed, stating that "the general purpose of the marriage amendment is to preserve the legal status of marriage in Wisconsin as between only one man and one woman." Further, the opinion handed down recognized that the process through which the amendment was adopted conformed to the state constitution and "is properly now part of our constitution." Julaine Appling of the Wisconsin Family Council had this reaction to the ruling. "It is not a very easy thing to do in a state like Wisconsin with a Supreme Court of the nature that we have to get a 7-to-0 ruling," she observes. "So this is clearly of the Lord, and we are rejoicing in his goodness." Appling says proponents of homosexual marriage used their usual trick -- they could not win in the legislature, so they took the issue to court to try to circumvent the will of the people. The Family Council spokeswoman says those proponents essentially said "Alright, you won in the election in November of 2006, but we're going to take you to court and make you go through all the hoops on a technicality and try to overturn what the people of this state wanted." The court has now said "No, you lose on that technicality," Appling concludes. In that election almost four years ago, 59.4 percent of the people approved the constitutional amendment to hold true to the traditional view of marriage.
