Two California attorneys have filed suit in federal court to overturn Proposition 8, which voters approved last year to define marriage as strictly between one man and one woman.

 

Prop. 8 legal battleThe lawsuit is yet another attempt by the advocates for redefining marriage to overturn the 52 percent vote and to amend the Constitution, according to attorney Austin Nimocks of the Alliance Defense Fund.
 
"In America we respect free and fair elections," he notes. "Proposition 8 was, in fact, a free and fair election representative of everything America stands for -- and yet the advocates for redefining marriage want to once again try and use the courts to subvert the will of the people."
 
Nimocks explains homosexual activists use the courts because it is about the only resource avaiable to them in most states, if they hope to gain victory. As he points out, popular votes tend not to support the radical homosexual agenda when it comes to marriage.
 
"In 30 out of 30 states that have voted on marriage, [voters] have upheld marriage," the attorney adds, "and so the advocates for redefining marriage want to use the courts to try to beat down the people and make sure the voice of the people is snuffed out."
 
The Alliance Defense Fund has already appeared in the new federal lawsuit representing the Proposition 8 campaign and will pursue the case until there is a final decision.
