Pro-lifer sues hospital over rights violation

gavel smallThe Alliance Defense Fund (ADF) is defending nurse Cathy Cenzon-DeCarlo's right to conscience after the hospital insisted she participate in a late-term abortion against her will.

 

ADF filed a lawsuit against Mount Sinai Hospital in New York on behalf of the Catholic nurse because she was threatened with possible termination if she refused to participate. Attorney Matt Bowman is representing her.
 
"This hospital has known of her objection for almost five years," he notes. "And even though it receives federal funds that require it by law not to force employees to participate in abortion, it forced her over her strenuous objection to assist in this abortion of a 22-week-old child."
 
According to an ADF press release, the patient was not in a crisis at the time of the surgery and the hospital could have asked another nurse to participate. A "Category I" case is reserved for a patient requiring immediate surgery for life-threatening conditions, while a "Category II" classification is for operations needing to occur within six hours. The hospital claimed this particular abortion case was an emergency; however, records show the patient's condition was not labeled even a Category II.

Bowman is asking the court to require the hospital to uphold the federal law.
 
"Chasing away workers from the healthcare field is disastrous healthcare policy," he adds. "An individual's conscience is likely what brought them to the healthcare field, and denying or coercing their conscience will likely drive them right out."
