ADFA student will drop her lawsuit against Westmont High School of San Jose, California, after the school agreed to give a pro-life student club the same recognition and privileges of other clubs on campus.

An attorney for the student says her written request to the school to start the "Live Action - Pro-Life Club'' and receive standard rights and benefits was denied on the basis that it was too controversial -- even though other clubs granted recognition status included a Gay Straight Alliance club.

David Cortman of Alliance Defense Fund (ADF) says the student contacted ADF and a lawsuit with a preliminary junction was filed. However, the school had an immediate change of heart. "I think they realized that with all the other clubs they had allowed, the Constitution required that they allow the pro-life club, regardless of whether they thought it was too controversial," says Cortman.

Cortman says "Live Action" was granted official school recognition the day after the lawsuit against Westmont was filed, and at the club's initiation 40 students were able to hear the pro-life message.
