The Alliance Defense Fund (ADF) has filed suit against the District of Columbia Board of Directors, asking them to have a change of heart.
The Election Board voted against allowing citizens to vote on a referendum to block homosexual marriage, and that prompted the lawsuit. "That's what this is about, is appealing to the Court in order to vindicate the people's right to vote on what is probably the biggest social issue of our time, and that is the definition of marriage," contends Tim Tracey of ADF. Yet the Election Board says that giving residents the right to decide the issue would violate the city's Human Rights Act, or anti-discrimination law. "Really the only right at issue here is the people's right to vote," Tracey notes. "We're sitting in the center of democracy of the world in the District of Columbia, and it's ironic that the Board of Elections is telling the people of DC that they can't vote on this." Voters in 31 states have had the opportunity to vote on the issue of marriage, and Tracey contends that voters in DC ought to have that same right. ADF is asking the court to order the Board to accept the initiative and proceed on putting the issue on the ballot.
